1. General information about the owner of the website
The purchase and sale of products, courses and services through this website is conducted under the name TOPMODEL by TOPMODEL CLUB S.L., parent company of TOPMODEL group (hereinafter the Group), registered in the Commercial Register of Madrid, in volume 3369, book 1, folio 127 and page GI-71187, on 23-03-2023. 2. Conditions of purchase
The formalization of the order implies, in any case, the acceptance of the present conditions of purchase. This formalization is understood once received the confirmation email with the details of the purchase made by the user.
3. Product availability
All orders are subject to the availability of products, so if there are incidents in terms of supply or if there are no products in stock, the customer will be informed immediately, and will be reimbursed the amount of the product or products out of stock. In this case, Topmodel will reimburse the corresponding amount without undue delay by the same means of payment with which it was paid. In the event that a product is not available, but others within the same order are, the user will be informed by phone or email of the partial cancellation of the order. The partial cancellation of the order due to lack of availability does not entitle the user to the cancellation of the entire order. If as a result of this cancellation the customer wants to return the delivered product must follow the stipulations in the returns section.
4. Prices
The applicable prices are those indicated on the website on the date of the order. Also, the products added by the user in the basket will always reflect the most recent price shown on the product details page. The prices shown on each item include VAT (Value Added Tax), IGIC (Canary Islands General Indirect Tax), IPSI (Tax on Production, Services and Imports in Ceuta and Melilla), or taxes payable in accordance with the applicable regulations in the country from which the purchase is made, as appropriate.
5. Methods of payment
The user agrees to pay for the purchase at the time the order is placed. The proof of purchase will be available and can be viewed in the "My account" section in "Orders" of the website as well as in the confirmation email that formalizes the purchase. The user must pay the amount corresponding to your order by any of the means that are enabled at the time of purchase, preferably through credit or debit card (Visa, Mastercard, American Express, Visa electron and / or other similar cards) and / or through alternative payment systems: Paypal, Amazon Payments, Apple Pay, Google Pay or Shopify Pay.
6. Shipping costs
Shipping costs depend on the total amount of the purchase and the delivery point, which are calculated at the time of purchase. Shipping costs may be assumed by Topmodel if within a promotion this advantage is specified. These shipping cost promotions are usually subject to the purchase of a minimum amount. In Spain, shipments to the Canary Islands, Ceuta and Melilla will be subject to customs and / or import charges in addition to the amount of the order: - In the Canary Islands (approx.) 18 € DUA + 7% IGIC. - In Ceuta and Melilla (approx.) 18€ DUA + 7% clothing / 10% footwear IPSI. Both in domestic shipments to Spain and international shipments, customers will assume the corresponding customs and / or import costs, if any. 7. Discount Codes
Topmodel promotions or discount codes are not cumulative, and are limited to one per person per online order. Only one discount code can be used per order and per shopping cart. That is, they can be used on a single purchase of one or more products purchased through the website. Discount codes are non-refundable and cannot be redeemed for cash. Terms and conditions regarding the validity of the code are included with each purchase. If you have a promotional code you will be able to use it before finalizing the order in the 'Summary of your purchase'. Enter the promotional code and click 'Apply discount code'. If the discount code is valid you will see the discount applied in the purchase summary. In case of return or exchange, the value of the code will not be refunded.
8. Orders
Topmodel undertakes to deliver the product in perfect condition to the address provided by the user on the order form. This address may be different from the buyer's address. In order to optimize delivery, we kindly ask the user to indicate an address to which the order can be delivered during normal business hours. Topmodel shall not be liable for delivery errors caused when the delivery address entered by the user in the order form does not correspond to reality or has been omitted.
8.1. Delivery methods
Spain/peninsula
For purchases made in Spain this must be included in any case, within the peninsula and / or Balearic Islands. Free shipping costs for purchases of an amount equal to or greater than 40 € for orders destined for the peninsula or the Balearic Islands, and 90 € for orders destined for Ceuta, Melilla or the Canary Islands. For orders of lower amount apply standard shipping costs of 4 € on the peninsula and the Balearic Islands. In the case of Ceuta, Melilla and the Canary Islands, the standard shipping rate is always 12€. The order will be delivered within approximately 3 to 7 working days from order confirmation. This period may be longer in periods of sales, Black Friday or specific promotions without the user being entitled to claim compensation or compensation for such delay.
9. Return policy
9.1. Right of withdrawal
The Customer has the possibility to withdraw from his order without having to justify his decision within fourteen (14) calendar days from receipt of the Products ordered, taking as a reference the date appearing on the receipt of the carrier signed by the Customer. In the event that the expiration date of such fourteen (14) day period coincides with a Saturday, Sunday or holiday, the period shall be extended to the next business day.
9.2. General conditions of return
Without prejudice to the rights arising from the regulations on withdrawal and independently and in addition to this, if for any reason the user is not satisfied with the order, has received another product by mistake or has some kind of damage, you can return it within 30 days from the date of delivery. There are several conditions that the product must meet in order to be returned:
- It must not be used.
- It must not have been damaged in any way.
- It must have its internal and external label.
The delivery of several products must be made in the same box where we sent it to you or in a similar format.
10. Intellectual and industrial property
Topmodel is the exclusive owner of the rights relating to its website and its social networks, therefore, all content, graphic design and codes that are part of https://Topmodel.club/ and its domains are the exclusive property of Topmodel. Their reproduction, distribution, public communication, transformation or any other activity carried out with the contents, even if the sources are cited, is prohibited, except with the express prior written consent of Topmodel. Therefore, they are protected by the Intellectual Property Law. Topmodel does not grant any authorization of use of any kind on its intellectual and industrial property rights or on any other property or right related to the website, and in no case shall it be understood that access and browsing by users implies a waiver, transmission, license or total or partial transfer of such rights by Topmodel Any use of such content not previously authorized by Topmodel will be considered a serious breach of intellectual or industrial property rights and will give rise to the legally established responsibilities. That is why Topmodel undertakes to take all reasonable technical and security measures to ensure that they are deleted or rectified without delay when they are inaccurate or untrue.
